    When a global higher education technology provider was negotiating a multi-million dollar deal to provide its software to an Australian education institution, they needed help navigating Australian law. Macpherson Kelley’s team spent four months working on the deal with our client and the education institution ensuring the terms of the deal satisfied Australian laws and the education institution’s specific needs. Our team was able to transform the education institution’s standard terms document into a balanced and robust contract tool that catered for the specific products and services supplied by our client, creating value for both sides of the agreement.

    The Murray Darling Basin river system spans four states so delivering a computer software solution to manage water rights in the system was a complex piece of nationally important infrastructure. Negotiating an agreement between the US-based software provider, the government department managing its implementation, and the software integrator was also complex. Acting for the software provider, we negotiated the deal covering the obligations and risk apportionment of the parties until all were satisfied. We also addressed strict international accounting requirements our US-based client faced. A deal was reached and the Basin now has a tailored software solution to manage water rights and our client has established a presence in Australia it intends to build upon.

    An Australian technology company brought together software and hardware to create a new generation digital video network enabling high quality video images to be watched on mobile phones. When the company supplied its system to a large Australian telecommunications company, they turned to Macpherson Kelley to make the deal.
