Insolvency – Ben acted for a major creditor of a company in liquidation in an application to set aside a Deed of Company Agreement. The setting aside of the Deed of Company Arrangement would allow a $1 billion Deed of Covenant to be called upon to allow payment of all creditors in full.
Insolvency – securities matter – Ben has advised government bodies regarding whether insolvency practitioners were complying with their statutory obligations in relation to priority of payments and security interests. Ben has an excellent understanding of the statutory obligations of insolvency practitioners contained in the Corporations Act (2001) and the Personal Property Securities Act (2009) and is able to advise insolvency practitioners, creditors and stakeholders alike.
