Prue is highly experienced in dealing with franchising disputes, general commercial litigation, debt recovery and insolvency matters. Prue takes a commercial and strategic approach to all her matters as her strategy is a key driver in helping her achieve the best possible outcome for her clients.
Prue has built a strong practice in the franchising space where she deals with a range of issues including recovery of fees, intellectual property, restraint issues, dealing with serious breaches and providing advice in respect of the Franchising Code of Conduct. When working with franchisors, Prue’s focus is the protection of their brand and reputation. When working with franchisees, Prue’s ensures they are afforded adequate protection under the Code including negotiating end of term or early release arrangements, including sale of the franchise.
In addition, she also has experience in contractual disputes, leasing disputes, claims under the TPA and CCA, IP claims, property disputes, insurance and building and construction disputes.

Significant matters
Victorian automotive service industry franchisor – franchisee in breach of their Franchise Agreement. Successfully took over the management of the store, recovered outstanding royalties, applied restraints in relation to intellectual property and brand.
National entertainment industry franchisor – franchisee in breach of Franchise Agreement contract by denying the option for franchisor to Purchase the Assets of the store at the end of the term.
Victorian supply company – successfully opposed an application to set aside a Creditors Statutory Demand for Payment of Debt on the grounds that the plaintiff did not have a genuine dispute to the debt
Victorian recruitment company – who terminated their Agreement with their IT provider. Successfully negotiated a resolution that avoided payment of the majority of the claimed termination fee.
