Cain’s large retail client wanted to assign, licence or where it was landowner, lease a large number of its company owned stores throughout each State and Territory in Australia to its corporate franchisees. Cain was heavily involved in the preparation, negotiation and completion of the documents ranging from assignments of lease, licences, leases and subleases and worked with a multitude of landlords and franchisee lawyers in order to achieve the desired outcome for all parties involved.
Cain assisted a client who was a tenant in a large retail shopping centre about to embark on a major redevelopment. The client’s lease did not contain a relocation or demolition clause however, Cain was able to negotiate a fantastic settlement for the client which ensured appropriate compensation and a new lease on favourable terms once the shopping centre was rebuilt. This ensured the client’s business did not suffer financially and was successfully up and running after a period of closure.
