Kate’s client faced an unfair property settlement application in a complex case involving both Family and Estate law. The highly complicated family situation included multiple parties, some of whom were vexatious. Kate was wholly successful in obtaining orders dismissing the opposing side’s application for a property settlement against her client. Kate lead a team effort that saw the successful result for the client as well as obtaining indemnity costs for the client, something which is rare in Family Law matters. The client obtained a just outcome and was able to move onto the next stage of her life with certainty and financial security.
Kate successfully mediated a property settlement for a client with significant business assets without needing to go to Court. Through her meticulous preparation, a thorough business valuation and briefing Counsel early for detailed, strategic advice Kate was able to negotiate with the other party’s lawyer early on. This helped to ensure there was goodwill between her client and the other side, resulting in avoiding court and a very good outcome for the client and his business. The client was able to move onto the next phase of his life, co-parenting their child with his former partner with a level of dignity and respect between the two.
In a division of assets, Kate uncovered assets that had been hidden by her client’s partner. After reviewing a large number of bank statements and financial documents, Kate found assets owned by the other party which were never disclosed, showing they were trying to avoid a just and equitable division of the assets. The uncovered assets significantly increased the size of the asset pool for division, resulting in a significantly improved position for the client.
