Tom acted for a property development company and the majority of its shareholders in proceedings against a former director. The proceedings involved a multitude of claims, including claims for breach of directors’ duties, breach of fiduciary duties, fraud, deceit, and fraudulent concealment. Following a complex analysis of the defendant’s conduct, which included an examination of hundreds of payments described by the Court as a “labyrinth”, Tom’s client obtained a judgment in excess of $5 million, plus interest. Following judgment, Tom assisted his client by obtaining a fixed sum costs order against the defendant for $2.8 million, before commencing recovery action (including freezing orders) which resulted in a payment of all amounts owed by the defendant.
Tom acted for an ASX-listed company in respect of an investigation by ASIC into suspected insider trading by officers of the corporation. Tom engaged with the regulator and third parties to assist his client to comply with ASIC’s requirements in a cost-effective and efficient manner and managed a simultaneous internal investigation into the subject matter of ASIC’s enquiries. The rapid mobilisation of the investigation allowed Tom to provide quick and clear advice to his client in anticipation of ASIC’s investigation progressing.
Tom has acted for numerous individuals, including executives and employees, in respect of investigations conducted by ASIC. Tom assisted those individuals in dealing with ASIC, responding to notices to produce, and preparing for and attending section 19 examinations. Tom focuses on ensuring that his clients are properly prepared and represented during the investigation process.
