Application for an urgent Grant of Representation to enable a horse racing and breeding enterprise conducted in Victoria, New South Wales, America and France to be liquidated to stem high running costs, avoid potentially insolvent trading and to deal with future of horses.

Represented child regarding her mother’s Will – A mother of an only child left her entire estate to a taxi driver. Will was drawn in suspicious circumstances (undue influence) and the mental capacity of the mother was an issue. Result saw the child’s entitlement go from 0 per cent to 95 per cent.

Complex Estate planning for a large property developer with three failed marriages (children of each and estranged ex-wives) and complex asset structure (28 trusts, 4 self-managed super funds, 8 joint ventures, 3 franchises and 23 companies). Planning involved restructuring advice and implementation, Deeds of Variation, testamentary trust Will, Binding Death Benefit Nominations, Powers of Attorney and Memorandum of Wishes.

Poorly constructed Will – Issues involved gifts of land parcels by names rather than by specific description and reference to a charitable beneficiary where there was no charity known by that name. Litigation ensued regarding which parcel of land belonged to whom and what precise charity was intended to benefit. Application on behalf of Executors to the Supreme Court for judicial guidance regarding the land and a cy pres application regarding the charity.
