Libby is a Special Counsel in our Litigation and Dispute Resolution team. She has a particular focus on intellectual property (patents, trademarks, designs and copyright), property, contractual disputes, shareholder disputes and misleading and deceptive conduct claims with expertise in applications for urgent court relief.
Libby has a reputation for dealing with complex commercial matters with a practical approach, and prides herself on being able to resolve disputes in a fast and cost-effective way for her clients. Her experience includes successfully obtaining multiple low cost outcomes for clients in enforcing trademarks and successfully obtaining and executing Supreme Court Search Orders for her clients.

Australian equipment designer/manufacturer – advised and represented at the Royal Commission: Oil for Food Inquiry. The company was cleared of any wrongdoing.
Australian importer and wholesaler – successfully obtained urgent ex parte Supreme Court relief to enforce PMSI rights and restrain purchaser (who failed to make payment) and interested third parties from dealing with our client’s goods.
Australian sports equipment manufacturer and distributor – successfully negotiated alleged breach of Australian patent to obtain a royalty-free license and additional international rights.
Victorian animal and veterinary supplier – successfully negotiated for a large multi-national to permanently cease and desist use for client’s trade mark without the need to issue court proceedings.
Individual and Family Trusts – successfully negotiated the return of their combined multi-million dollar property loan to the property developer company when the property development went awry. This was executed despite poor documentation, limited security and debtor assets.
Castricum Brothers Australia Pty Ltd – successfully defended (on Appeal) the validity of our client’s rescission of a sale of a $9M commercial property and termination for breach of an implied term in a related equipment sale.
