  • mortgagor returns home after mortgagee’s unlawful mortgage

    A Sydney-sider was duped into taking out a high interest loan from a lender of last resort to purchase an investment property in Queensland. Within months, the excessive interest rate caused the loan to fall into default. Without notice, the lender used a general power of attorney under the loan agreement to grant itself a mortgage over the Sydney-sider’s home and evicted the Sydney-sider by force. James acted for the Sydney-sider in urgently invoking the cross-vesting jurisdiction of the Supreme Court of Queensland and successfully obtain an injunction returning the Sydney-sider to his home and for the removal of the mortgage over the home.
