about Nicole

Nicole Treacey practices exclusively in the area of succession law.  Nicole is passionate about formulating practical estate planning solutions for clients, with a particular focus on those with structures (such as companies and trusts), blended families and client with complex situations, such as children with disabilities.

When it comes to litigation, Nicole understands that disputes between family members need to be managed carefully.  Nicole takes a commerical approach to resolving disputes, with the view to preserving the chance of reconciliation between family members at a future point in time.

Nicole is passionate about helping people going through the estate administration process, which is a difficult time for families, particularly where there are complex matters to resolve.

Whether she’s planning for future generations, resolving issues when the unexpected occurs, or sorting out problems left behind, Nicole draws on fifteen years of experience in succession, commercial and property matters. She is known for her lateral thinking and is adept at asking the right questions to build relationships that gain an in depth understanding of her clients’ needs and but also their trust.

  • Complex Estate Planning – blended family

    Nicole acted for clients from blended family who took 15 years to do their estate planning.  They had seen many lawyers, and tried many times to find a strategy that worked for everyone, but the clients had all but given up.  There were complexities such as an adult child/step child with a disability and another one with addiction issues, it was a second marriage for both clients, each client had a different amount of children and there were overseas assets.  The clients finished with a strategy and a plan that achieved all of the clients’ goals, giving them peace of mind that all parties were ultimately taken care of.

  • Estate dispute - enduring power of attorney misappropriation

    Nicole acted for a client where monies were being misappropriated by the attorney.  Nicole successfully obtained an order from QCAT for the attorney to be removed, which successfully ensured that all monies were repaid and further misappropriation was not able take place.

  • Prevention of challenge of Will

    Nicole assisted a client with a terminal diagnosis restructure her property and superannuation assets to prevent a claim for further provision by her estranged son. The client passed away peacefully just hours after Nicole saw her to advise that the restructure was complete.

  • Large construction business management on death of key person

    Nicole assisted with the administration of an Estate and provided practical assistance when the business owner died unexpectedly. Nicole advised the Executor and company on a range of issues including finalising the fit-out of a large development it was contracted to complete, payment of wages and managing day-to-day operation of the business. She also dealt with matters that arose due to the sudden death, including the construction supervisor nominee issues, ensuring ongoing funding was available to complete the project and liaising with WorkCover to ensure the business could continue to trade until the Estate was finalised. The Executor and the family were relieved to be able to rely on Nicole for guidance in such stressful circumstances.
