With a background in engineering and information technology, Paul’s clients benefit from his broad range of industry experience that helps owners and managers navigate IP and trade matters. Working closely with manufacturers and importers, Paul advises across the full product lifespan, from creation, protection and production, through to distribution models, warranty and product recalls.
Paul is a Director of Macpherson Kelley and is the firm’s National Head of the IP & Trade Group. Paul has authored many articles and publications, both Australian and international publications including the Australian Chapter of Media, Advertising and Entertainment Law Throughout the World.

Automotive accessories manufacturer – to implement an IP protection strategy as they developed a new product prior to bringing to market. Additionally, advised on exclusive distribution strategies and drafted distribution agreements. Once the product hit the market, it was copied by a competitor. As a result of the protection strategy, and without going to Court, we obtained recall of infringing products and catalogues and stopped online sales. We also obtained undertakings from the competitor to deliver up for destruction all items, payment of damages on lost sales and legal costs.
Manufacturer – developed a product recall strategy to recover and correct a client’s product that did not comply with mandatory standards, lead negotiations with the ACCC, provided advice on the applicable Standard, and assisted the client conduct the recall. Additionally, provided ongoing Trade Practices Compliance Program and future product and marketing signoff. As a result, the client avoided court action and fines.
Commercial services – assisted client convert their significant business into a franchise model. With the client and accountant developed the franchise model franchise, documented it in compliance with the Franchise Code. On going, helped the client expand through Master Franchising in other States and helped manage the range of issues franchisors experience. With my IP knowledge, also protected the client’s trade marks through trade mark registration and the system’s confidential systems and procedures through confidentiality.
