  • persistence pays off in fight against worksafe

    Never-wavering persistence along with creative legal work, Barney was able to save his client, a longstanding family-run business, when regulator WorkSafe suddenly suspended its licence to operate indefinitely without warning. Coming from a weak legal position, Barney attempted seek the particulars for the suspension and rights of review along with court action to have the suspension lifted until a final decision was made. Although unsuccessful, Barney did not back down, lobbying local government members, informing them of the situation whilst preparing a freedom on information request. Persistence paid off with the reviewer decided to not cancel the client’s licence, allowing them to get back to business.

  • smooth management of major industrial factory accident

    The team were contacted at 5 pm on a Friday evening following a major industrial accident at the meat manufacturing plant of a client. With quick thinking and expert knowledge they were able to provide initial advice over the phone that the client was able to act on immediately to ensure the correct management of the accident happened. Following this initial advice, Barney and team conducted a compliance investigation which was then followed by a full investigation with external OHS professions. Although a distressing situation for the client, Barney guided the client through the necessary steps, calmly managing all aspects.

  • making the best of a bad situation

    Barney’s client was charged with breaches of the Occupational Health and Safety Act 2004 following a workplace accident. The injured worker had long since returned to work with support from the client, but WorkSafe had resolved to prosecute. Working closely with counsel, Barney guided the client through this stressful situation and the matter was resolved with a modest fine and no conviction recorded. Pleased with the excellent level of service, the client has since returned to Barney on multiple occasions as a first port of call for commercial and employment matters.
