  • professional negligence

    Damien acted for a property manager of a large apartment complex, who had negotiated to enter into a lengthy and lucrative caretaking and letting agreement for an apartment building on the Gold Coast. Following execution of that agreement, an adjudicator from the Office of the Body Corporate and Community Management Commissioner set aside that agreement due to defects in the voting procedures and documentation provided to body corporate members prior to the body corporate passing a motion to execute the caretaking and letting agreement. Damien’s client alleged its former solicitors had acted negligently in the provision of advice to the client and preparation of certain documents to facilitate the transaction in question.

    With Damien’s assistance, the dispute resolved at mediation, resulting in a successful outcome and payment of compensation to the client, and avoiding the need for a costly and time-consuming trial of the proceeding.

  • intellectual property dispute

    Damien acted for the owner of a number of trade marks associated with a well-known motorsports brand, which discovered that counterfeit goods were being imported into Australia and sold using its trade marks. After the seller of counterfeit products rejected offers to settle the dispute in pre-litigation settlement discussions, Damien assisted the client to commence Federal Circuit Court proceedings for breaches of the Trade Marks Act and breaches of the Australian Consumer Law. Damien then helped to negotiate a settlement of the dispute prior to the first court date, which resulted in the seller of counterfeit goods compensating the client for unauthorised use of the trade marks and paying the client’s legal costs.
