Acted for an Applicant Wife who was found by the Court to have made significant contributions to the relationship via her bodily participation in extensive fertility treatments. The client unfortunately was not able to conceive however the contribution she made in her attempts was clearly an exceptional one. After the relationship ended the Respondent Husband came into a significant inheritance which was hidden during the earlier part of the proceedings. The asset pool available for distribution was significantly enlarged once the Husband’s inheritance was brought to the attention of the Court and the Husband’s Mother was joined to proceedings as a result of the family’s efforts to conceal their arrangements.
Complex 3-year high-conflict property and parenting litigation –ending in a trial in the FCFCOA. Acted for Applicant Husband: The matrimonial property was determined to be subject to a constructive trust and a third party (the Wife’s Father) was joined to proceedings. The outcome to our client was a significant share of the proceeds in the property once the portion was allocated to the third party by way of a trust and that the parties’ children remained living with our client. Also successfully took possession of the family dog at an interim stage which was of immeasurable importance to the client and his children.
Acted for a Respondent Wife in a parenting litigation. This concerned a child with significant needs. Case ended after Dispute Resolution Conference resulting in the Father relocating back to Melbourne from Queensland (instead of the child being relocated to Queensland). The Mother also successfully secured funds to obtain much-needed therapeutic assistance as part of the settlement.
Acted for a de facto Wife in a multi-million-dollar settlement at the conclusion of a de facto relationship via a Financial Agreement.
