about Kym

With over 25 years of legal practice in South Australia, Kym Ryder brings deep expertise and a pragmatic approach to complex disputes and insolvency matters. He has advised a broad range of clients, including businesses, associations, individuals, and sporting organisations, on matters ranging from corporate reconstruction and debt recovery to professional negligence and trade practices disputes.

Kym is known for his strategic, commercially focused advice and his commitment to resolving disputes efficiently and cost-effectively. He places strong emphasis on early intervention and alternative dispute resolution and has recently conducted the College of Law’s Intensive Mediation Course.

His practice spans commercial and civil litigation, insolvency and reconstruction (including bankruptcy, liquidation, and voluntary administration), building and construction disputes, franchising and landlord-tenant matters, insurance law, and wills and estate disputes.

Kym is a Fellow of the Australian Reconstruction, Insolvency and Turnaround Association (ARITA), a member of the Banking and Financial Services Law Association, a former ARITA (SA Division) Committee Member, and the current SA Deputy Chair of the Law Council’s Insolvency and Reconstruction Law Committee. He also served as a director of the Adelaide Crows Football Club, reflecting his strong connection to the business of sport.

  • trustee’s claim to assets maintained: Pitman v Johnson [2017] FCA 945 (17 August 2017)

    Kym acted for a successful trustee in bankruptcy, ultimately maintaining their claim to assets vested in that trustee. The decision has been widely discussed in legal circles, highlighting Kym’s swift action and attention to detail in comparison to the arguments and documentation put forward by the other side.

  • voidable transaction proceedings: Johnson As Trustee of Bankrupt Estate of Portellos v J.S.J. & A. Nominees Pty Ltd [2020] FCCA 934 (23 April 2020)

    Kym acted for a successful trustee in bankruptcy in voidable transaction proceedings. The Federal Circuit Court found in favour of Kym’s client  as it was successfully argued that the transaction in question was not by an unrelated third party, but rather, was designed to avoid the unfair preference regime, rendering it void.

  • deed of company arrangement: Western Hospital Pty Ltd (in administration)

    In 2024, Kym acted for proponents of Deed of Company Arrangement for Western Hospital Pty Ltd (in administration). Kym negotiated DOCA terms of behalf of his client, advised on compliance and actively engaged with the administrator and creditors to secure a positive commercial outcome.
