significant matters

  • Restructure for tax exemption without duty

The client wanted to transfer their main residence in Queensland from a discretionary trust to a bare trust structure where the beneficiary was absolutely entitled to the property. Henceforth making the property eligible to claim the main residence exemption when they decide to sell the property. We were able to transfer the property without incurring duty.

  • Absentee ownership surcharge exemption

The client owned significant commercial real property in Victoria and also has a large economic presence. The client has a foreign parent company that owns all the shares in the Australian subsidiary and therefore, was paying the absentee owner surcharge for land tax. We applied to the State Revenue Office and were successful in obtaining the client a full exemption to the absentee ownership surcharge saving the client 4% on land tax in Victoria for future land tax years.
