‘Tis the season…to avoid a claim!

We all want our staff to enjoy Christmas with colleagues and clients but the season can bring out the worst in some.

Recent example

In Damien McDaid v Future Engineering and Communication Pty Ltd [2016] FWC 343 the Fair Work Commission upheld the dismissal of an employee who was aggressive toward other employees and pushed his manager into a pool at the Christmas party.

In dismissing the employee’s unfair dismissal claim, the FWC said employees need to be reminded that there are expected standards of behaviour (even where alcohol is consumed) and that their actions have consequences.
