wills and
estates

Writing a Will and planning for an estate demands attention to detail and a thorough understanding of what the Will maker wants to do. Any ambiguity could lead to disputes that end up damaging family relationships instead of providing the certainty the Will intended. Blended families add a layer of complexity that also needs to be considered. A good Will and effective succession planning provides certainty for all.

We look at the complete family picture when advising on Wills and estate planning. Understanding how everyone relates to each other and their stage of life helps us advise on what you want to achieve with your Will. We can also access our tax lawyers to assess taxation implications for estate plans and our family law team is available if there are family law issues such as second families to consider. Death happens to everyone. But having a Will as part of your overall succession plan can preserve family relationships for the future.

what our
clients say

“We are so grateful for all Macpherson Kelley’s Wills and Estates team’s hard work throughout this whole case. From the minute we walked into mediation it truly showed just how lucky we were to have such a professional team. When all this is finalised, it will make me one very happy person knowing my uncle can get on with the rest of his life without worry. Thank you so much.”

recent experience

  • peace of mind for the future

A couple with significant business interests wanted to ensure their business was protected for their daughters if they passed away. They wanted to ensure their daughters could continue the business and everyone knew their role and what to do if the parents died. Macpherson Kelley prepared Wills, Powers of Attorney, Appointments of Medical Treatment Decisions Maker, Binding Death Benefit Nominations and Deeds of Variation for their trusts. We then held an information session with the family so everyone was clear on what had been planned. While the parents were still only in their 50s, it gave them peace of mind that succession planning was in place and their daughters were provided for.

  • managing deceased estate…and looking after the animals

When an elderly couple with no immediate family but significant property interests passed away within weeks of each other, Macpherson Kelley administered the distribution of their estate. We managed the sale of their property, donations to various charities the couple wanted to support, and found homes for their farm animals, which they had considered their children. We made sure all their specific requests were met, including the installation of a plaque bearing their names at an animal shelter they supported.
