about Marcus

Always intrigued with technology, it was the fast pace and rapidly changing nature of technology law that drew Marcus to the field. Watching the law evolve to keep up with his clients and the work they are doing is something Marcus finds extremely exciting.

Having a general commercial background does allow Marcus to take a broader focus and a more holistic approach when it comes to matters. He knows it’s important to understand the nature of his clients’ businesses as well as the technology aspect as this then informs how he will tackle things such as agreement structures or negotiations.

As the legal landscape has not always caught up with what clients are doing, clients look to Marcus for legal interpretation when it comes to what their business can and can’t do.

“It seems clichéd but client service is something I do really focus on. I think it’s about getting a really good result for the client, helping them through the process as their lawyer, and being a part of their team as we tread new ground together.”

  • master service agreement

    Working with the sales team and in-house counsel at an international IT company, Marcus helped negotiate the terms of a large deal for the supply of software to an Australian superannuation firm within a very tight timeframe. Marcus worked tirelessly to complete the client’s deal prior to the end of the quarter, a result which meant the client was able to exceed their sales target in the APAC region for that quarter.

    Marcus assisted a Software-as-a-Service (SaaS) supplier negotiate the terms of a SaaS Agreement with one of the largest mining companies in the world. Marcus was relentless until the parties were able to reach an agreement, contending with multiple time zones and six months of late night conferences required to conduct the negotiations. Marcus was able to achieve a successful outcome for all involved, creating the foundation for a good ongoing working relationship.

  • mandatory data breach notification

    After an unauthorised access of the client’s systems by a hacker, Marcus helped the client navigate the various requirements of the Privacy Act and the Mandatory Data Breach Notification laws. Following Marcus’ guidance and advice, the client was able to properly investigate the breach, mitigate any further damages and successfully comply with its Privacy Act requirements.
